Emergence Consulting Group/Anantkaar are trade names of a Firm based out of New Delhi, India (“Anantkaar”). Your privacy is important to us, and so is being transparent about how we collect, use, store, transfer and share information about you. This Global Privacy Policy (“Policy”) explains how we may use the information we collect about you when you use our website, do business with us or otherwise interact with us by attending one of our events.

Introduction

Anantkaar is an Indian personal and professional growth, training and development firm and a Business and Management Consulting firm.

This Policy gives effect to our commitment to protect your personal information. and has been adopted by all individuals who are Executives, Consultants, Affiliates, Agents and Assign. References to “Anantkaar”, “we” “us” and “our” throughout this Policy, depending upon the context, collectively refer to all such individuals.

Scope of this policy

This Policy applies to personal information that we obtain about our customers and the other individuals with whom we do business and to the use of that personal information in any form – whether oral, electronic or written, all in accordance with applicable global data privacy laws. The term “personal information” in this Policy refers to information that does identify or is capable of identifying you as an individual. This Policy applies to all the products, services, websites and apps offered by Anantkaar (“Services”).

Definitions

For the purposes of this and related documents, unless the context otherwise requires,

  1. “Act” means the Information Technology Act, 2000 (21 of 2000), as amended, enacted, repealed from time to time;
  2. “Biometrics” means the technologies that measure and analyse human body characteristics, such as ‘fingerprints’, ‘eye retinas and irises’, ‘voice patterns’, “facial patterns’, ‘hand measurements’ and ‘DNA’ for authentication purposes;
  3. “Firm” or “Anantkaar” means “EMERGENCE CONSULTING GROUP (AKI or AKI)” a proprietorship firm (Udyam No. DL-02-0026111 and GST No. 07AJNPK6221D1ZE) having its registered office and principal place of business located at 198, A.G.C.R. Enclave, Road No. 72, Anand Vihar (IP Extn. Part II), Delhi 110092, India
  4. “Customer” mean such natural persons who provide sensitive personal data or information to the Firm through the website https://anantkaar.com/
  5. “Cyber incidents” means any real or suspected adverse event in relation to cyber security that violates an explicitly or implicitly applicable security policy resulting in unauthorized access, denial of service or disruption, unauthorised use of a computer resource for processing or storage of information or changes to data, information without authorization
  6. “Data” means a representation of information, knowledge, facts, concepts or instructions which are being prepared or have been prepared in a formalised manner, and is intended to be processed, is being processed or has been processed in a computer system or computer network, and may be in any form (including computer printouts magnetic or optical storage media, punched cards, punched tapes) or stored internally in the memory of the computer;
  7. “Information” means Personal Information and/or Sensitive Information and shall includes data, message , text, images, sound, voice, codes, computer programs, software and data bases or micro film or computer generated micro fiche;
  8. “Intermediary” with respect to any particular electronic records, means any person who on behalf of another person receives, stores or transmits that record or provides any service with respect to that record and includes telecom service providers, network service providers, internet service providers, web hosting service providers, search engines, online payment sites, online-auction sites, online market places and cyber cafes;
  9. “Password” means a secret word or phrase or code or passphrase or secret key, or encryption or decryption keys that one uses to gain admittance or access to information;
  10. “Personal Information” means any information that relates to a Customer, which, either directly or indirectly, in combination with other information available or likely to be available with a Firm, is capable of identifying such person;
  11. “Sensitive personal data or information of a person” or “Sensitive Information” means such personal information of the Customer which consists of information relating to;—
    • password;
    • financial information such as Bank account or credit card or debit card or other payment instrument details ;
    • physical, physiological and mental health condition;
    • sexual orientation;
    • medical records and history;
    • Biometric information;
    • any detail relating to the above clauses as provided to Firm for providing service; and
    • any of the information received under above clauses by Firm for processing, stored or processed under lawful contract or otherwise:

provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of these rules.

“Services” means consulting, coaching, training, mentoring, education, adivisory services provided by the Firm through their website i.e. https://anantkaar.com/  to enable the Customers to buy goods and services through the internet.

Consent for Collection of Information under Rule 5 of IT Rules:

The Customer gives its consent under Rule 5 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011:

  1. The Firm collects certain Personal Information of the Customer, which may enable the Firm to either directly or indirectly, in combination with other information available or likely to be available with a Firm, is capable of identifying such Customer.

Without limitation the following information collected by the Firm in relation to its Services can be categorized as Personal Information:

  1. Customer Data or Information submitted by the Customer through forms, while availing the Services or inquiring about Services;
  2. Information recorded and collected though web server logs;
  3. Information collected through cookies or third party cookies;
  4. Information collected by third parties including advertiser, who may use some technologies such as web beacons, clear .gif or similar technologies to collect some information about the Customers;
  5. Information collected for analytical services to track user trends statistically.
  1. The Firm collects the following Sensitive Information of the Customer in connection with the Services of the Firm or any person on its behalf:
    • Password: In order for Customer to take full advantage of the Service, the Customer must provide registration information, including an e-mail address and password. The passwords are encrypted and then stored on the servers of the Firm and can be accessed by the Customers only.
    • Financial information such as Bank account or credit card or debit card or other payment instrument details: The payments for the Services can be made using third party payment gateways. Any financial information such as bank account or credit card or debit card or other payment instrument details the Firm receives in processing transactions varies according to the nature of the transaction and the way in which third party merchants are using our services. It generally will include Customer financial information such as banking details for making payments, account history including (without limitation) all billing information and communications, payment history etc. Customer Information is used to process payment transactions and for no other purpose.
    • Physical, physiological and mental health condition; The Customer while registering for the Services is required to provide information for profiling purposes such as the gender, marital status, age, contact details, address etc.;
    • any detail relating to the above clauses as provided to Firm for providing service; and Such other related information required by the Firm to efficiently provide the Services to the Customers, in relation to the Sensitive Information as mentioned above.
    • The collection of the Personal Information and the Sensitive Information by the Firm is considered necessary for providing the Services to the Customer;
  1. The collection of Information is subject to a condition that the Firm shall not retain the Information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force.
  2. The Information collected shall be used for the purpose i.e. providing the Services, for which it has been collected;
  3. Firm or any person on its behalf shall permit the Customers, as and when requested by them, to review the information they had provided and ensure that any Personal Information or Sensitive Information found to be inaccurate or deficient shall be corrected or amended as feasible: provided that Firm shall not be responsible for the authenticity of the Personal Information or Sensitive Information supplied by the Customer to Firm or any other person acting on behalf of Firm;
  4. Firm shall keep the Sensitive Information secure as per the reasonable security practices adopted by the Firm. Any person on behalf of Firm shall keep the Sensitive Information secure as per reasonable security practices adopted by the such third party.
  5. Firm shall address any discrepancies and grievances of their Customer with respect to processing of information in a time bound manner.

Consent for disclosure of Information under Rule 6 of IT Rules:

The Customer agrees to the following disclosures under Rule 6 of the IT Rules:

  1. The Information collected by the Firm including Personal Information or Sensitive Information may be disclosed to any person, if such disclosure is required for a lawful purpose connected with a function or activity or Services of Firm or any person on its behalf.
  2. The Information may be disclosed where the disclosure is necessary for compliance of a legal obligation.
  3. The information shall be shared, without obtaining prior consent from provider of information or the Customer, with Government agencies mandated under the law to obtain information including sensitive personal data or information for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences.
  4. Firm or any person on its behalf shall endeavor not to make public the Sensitive Information.
  5. Firm shall endeavor to ensure that that the third party receiving the Sensitive Information from Firm or any person on its behalf shall not disclose it further. However, the conduct of the third parties may not be directly under the control of the Firm.
  6. The Information shall be disclosed to any third party by an order under the law for the time being in force.

Consent for transfer of Information under Rule 6 of IT Rules:

Under Rule 7 of the IT Rules, the Customer consent that the Firm or any person on its behalf may transfer sensitive personal data or information including any information, to any other Firm or a person in India, or located in any other country.

Electronic Consent of the Customer:

The Customer acknowledges that the Services of AKI shall mean deem consent by the Customer for use, storing, transfer of the Information by AKI in the manner as provided in this privacy policy and the terms of use.

The Customer understands and acknowledges that:

  1. Sensitive Information and Personal Information is being collected by AKI;
  2. they have the knowledge of the purpose for which Information is being collected;
  3. they have the knowledge of the intended recipients of the information;
  4. they have the knowledge of the name and address of the agency that is collecting the information, and the agency that will retain the information;
  5. they understand that they have the option not to provide the data or information sought to be collected by AKI.

The Customer permits AKI or any person on its behalf to transfer Sensitive Information or the Personal Information to any other Firm or a person in India, or located in any other country.

The Customer understands that they also have an option to withdraw the consent by giving a written intimation to AKI. Customer understand and accept that such withdrawal of the consent shall be sent in writing to contact@anantkaar.com and in such case AKI shall have the option not to provide goods or Services for which the said Information was collected or sought.
